Sheetz employee, 22-year-old Demarcus Shamir Johnson, had previously flirted with the girl but her older sister warned him to stay away and told him her age, as detailed in the affidavit of probable cause.
The girl was drunk and went to the restroom to vomit, she was in and out of it and her memory was hazy but at one point she remembered leaning over the toilet to vomit. Next, she was standing up, walking, and sitting on the toilet. And then she recalled Johnson forcibly moving her head for oral sex at the Sheetz located at 529 East King Street on Oct. 30, 2022, according to the court documents.
At some point, she felt sleepy and couldn't tell what was going on, and when she awoke her pants had been unzipped and pulled down. She later recalled to police feeling "numb, hurt and scared," as stated in the affidavit.
It is unclear who called the police but Officers Matthew Pleisse and Lindsay Shope arrived with Shippensburg Area EMS arrived to find the young teen "laying in vomit and her pants were 'undone,'" they stated in the affidavit.
When she came to, she could remember her birthdate, address, or her mom. The police found her phone and left her mom a voicemail before she was taken in an ambulance to an area hospital.
On November 21st, 2022, the victim’s mother learned from her older daughter about the rape and contacted the police who interviewed Johnson. They also viewed the store surveillance footage from Oct. 30 and saw the two talking before the girl went to the Men's restroom followed by Johnson, according to court documents. Johnson entered and exited the area multiple times but the girl remained in the room until EMS carried her out, as explained in the affidavit.
The girl was interviewed by the Children's Advocacy Center on Dec. 16, 2022.
A warrant was issued for Johnson's arrest on March 2, 2023.
He was charged with statutory sexual assault, rape, sexual assault of an unconscious individual, indecent assault, and corruption of minors, according to his court docket.
His bail was initially set at $10,000, but this was later changed to $50,000 by Magisterial District Court Judge H. Anthony Adams. He posted it later that day and has been released from police custody, according to his docket.
His preliminary hearing is set before Judge Adams on March 15 at 10:45 a.m., as detailed in the docket.
Daily Voice reached out to Sheetz for comment on this incident and to verify Johnson's employment status with the company around 3 p.m. on Friday, March 3.
